Terms and Conditions

1. About These Terms

These Terms and Conditions (“Terms”) govern your use of the Elevated Medicine website, elevatedmedicine.org. “Elevated Medicine,” “we,” “us,” and “our” refer to our medical practice in Durango, Colorado.

Our website provides information about our practice and services, including platelet-rich plasma (PRP), orthobiologic treatments, ketamine infusions, and mental health care. Please review these Terms before using the website. If you do not agree with them, please discontinue website use. You may contact our office by telephone to ask about our services. These Terms concern website use.

They do not replace informed consent for medical treatment, patient financial agreements, our Privacy Policy, or our Notice of Privacy Practices.

2. Website Information Is Not Individual Medical Advice

The publicly available information on this website is provided for general educational and informational purposes. It is not a diagnosis, an individualized treatment recommendation, or a substitute for evaluation by a qualified healthcare professional.

Do not start, stop, or change medications or treatment based solely on website content. Do not disregard professional medical advice or delay seeking care because of something you read on this website. Visiting the website, reading its content, or submitting a general inquiry does not, by itself, establish a clinician-patient relationship.

This section does not change an existing clinician-patient relationship or apply to individualized medical advice provided by your treating clinician as part of your care.

3. Emergencies and Mental Health Crises

This website and its contact forms are not emergency services. Do not rely on website submissions, ordinary email, or patient portal messages for immediate assistance. For a medical emergency or immediate danger, call 911 or go to the nearest emergency department.

For a mental health or suicide-related crisis in the United States, call or text 988 to reach the Suicide & Crisis Lifeline. Do not wait for a response from our office when immediate help is needed.

4. Treatment Decisions, Informed Consent, and Outcomes

Descriptions of treatments on our website do not establish that a particular treatment is appropriate for you. Treatment recommendations depend on an individualized clinical evaluation, your medical history, potential risks, and other relevant circumstances. Our clinicians may recommend additional evaluation, a different treatment, referral to another provider, or no treatment when appropriate.

Before a procedure or treatment, we will discuss relevant risks, potential benefits, alternatives, and any required informed consent. Using this website or requesting an appointment is not consent to a medical procedure or treatment. Ketamine infusions for mental health conditions involve an off-label use of ketamine.

Ketamine is FDA-approved for certain anesthetic uses, but it is not FDA-approved for treating psychiatric disorders. We do not promise a particular treatment outcome, cure, degree of improvement, or duration of benefit. Patient stories, testimonials, photographs, and other examples on our website are not a guarantee of your individual results.

5. Appointment Requests and Availability

Submitting an appointment request expresses your interest in scheduling. An appointment is not confirmed until our office or an authorized scheduling system provides confirmation. A message acknowledging receipt of an inquiry is not necessarily an appointment confirmation. Appointment availability, treatment eligibility, and scheduling depend on clinical and operational considerations. We may need additional information or an evaluation before determining whether a requested service is appropriate.

Please provide accurate contact information and notify our office promptly if you need to change or cancel an appointment. Any applicable cancellation, rescheduling, late-arrival, or missed-appointment policies will be communicated separately. These website Terms do not establish a cancellation fee or authorize a charge to a payment method.

6. Fees, Insurance, and Financial Policies

Contact our office for information about treatment costs, available payment methods, and any insurance-related questions. Any applicable deposits, payment schedules, package terms, cancellation charges, and refund policies will be provided separately before they apply. Financial obligations are governed by the applicable patient financial agreement and law—not by browsing this website.

A treatment recommendation does not guarantee insurance coverage or reimbursement. Any information we provide about possible coverage is not a determination by your health plan. Website updates do not retroactively change agreed charges or eliminate your rights concerning estimates, billing, refunds, or payment disputes.

7. Website Inquiries and Communications

When you submit a general inquiry, you are asking Elevated Medicine to respond using the contact information you provide. Submitting a website form does not enroll you in a promotional email or text- message campaign. These Terms do not constitute consent to receive promotional messages.

Please provide only the information reasonably needed for us to respond. Do not submit detailed medical histories, sensitive mental health information, Social Security numbers, payment card information, or other highly sensitive information through general website contact forms or ordinary email. Contact our office for an appropriate way to provide sensitive information. You may also contact us to update your information or discuss your communication preferences.

Electronic messages may be delayed or fail to reach their intended recipient. For time- sensitive, non-emergency matters, contact our office by telephone.

8. Privacy and Electronic Health Records

Our Privacy Policy explains how we handle information collected through the website and related communications. Our Notice of Privacy Practices describes how we handle protected health information and explains your rights concerning that information. Elevated Medicine does not sell, rent, or trade your personal information or provide it to other businesses for their independent advertising, marketing, or solicitation. Our privacy documents explain the limited circumstances in which information may be processed by service providers or otherwise used or disclosed.

We use CharmHealth as our electronic health record system. CharmHealth is provided by MedicalMine, Inc. If our office provides you access to a CharmHealth patient portal,

that portal may have additional terms and privacy information governing its technology services. These Terms do not authorize uses or disclosures of protected health information that require separate authorization. A privacy notice or website agreement is not a substitute for an authorization required by HIPAA. Nothing in these Terms reduces the privacy protections or patient rights available to you under applicable law.

9. Appropriate Website Use

You agree to use the website lawfully and without interfering with its operation or the privacy and security of others. You may not attempt to access another person’s records or account without authority, impersonate another person, knowingly submit fraudulent information, introduce malicious software, interfere with website security, or use the website to threaten or unlawfully harass others.

You may submit information or requests on another person’s behalf only when you have appropriate authority. These restrictions do not prohibit lawful complaints, honest criticism, requests for accommodation, or the exercise of patient rights.

10. Website Content and Intellectual Property

Unless otherwise identified, the website’s original text, design, graphics, photographs, logos, and other materials are owned by Elevated Medicine or used with permission. You may view and print website content for personal, noncommercial informational use. Except as permitted by law or with the rights holder’s permission, you may not reproduce, sell, redistribute, or commercially exploit website materials.

You may not use our name or logo in a way that falsely suggests an affiliation with or endorsement by Elevated Medicine. This section does not restrict your rights to access or obtain your medical records, make legally permitted uses of content, or publish your own reviews. It does not transfer ownership of information or materials you submit to us.

11. Third-Party Websites and Services

Our website may link to independently operated websites or services, such as educational resources, financing providers, or patient portal services. A link does not necessarily mean that Elevated Medicine endorses all content, statements, products, or services on the linked website. Review the applicable terms and privacy information before submitting information or entering an agreement with an independent third party.

This section does not remove our legal responsibilities for service providers that handle information on our behalf.

12. Website Availability and Limits of These Terms

We work to keep the website useful and accurate, but information may contain errors or become outdated. Website features may be interrupted or unavailable because of maintenance, technical problems, or other circumstances.

To the extent permitted by law, we do not warrant that the public website will always be available, uninterrupted, or free of technical errors. Contact our office when you need to confirm information about services, scheduling, or pricing. These website disclaimers do not waive claims relating to medical care, excuse a failure to meet applicable professional standards, or eliminate our obligations concerning privacy, data security, truthful advertising, or consumer protection.

Nothing in these Terms excludes liability that cannot lawfully be excluded or requires you to waive a legally protected patient right.

13. Reviews, Feedback, and Complaints

You may share honest opinions about your experience with Elevated Medicine. These Terms do not prohibit or penalize honest reviews, require you to transfer ownership of a review, or prevent you from contacting a licensing board, government agency, attorney, or other appropriate recipient of a complaint.

Sending us feedback does not automatically authorize us to publish your identity, photograph, medical information, or testimonial. We obtain any permission or authorization required before using identifiable patient information in promotional materials.

14. Website Access and Accessibility

We may restrict access to website features when reasonably necessary to address misuse, security threats, maintenance, or legal requirements. Restricting website access does not, by itself, terminate an existing treatment relationship or eliminate your rights to request records or communicate with our office through other appropriate methods.

If you have difficulty accessing website content or using a website feature, please contact us. We will work with you to provide the information or assistance through an appropriate alternative method.

15. Changes to These Terms

We may revise these Terms to reflect changes to the website, our operations, or applicable requirements. Revised Terms will be posted with an updated effective date. Changes apply prospectively to website use, subject to any notice or agreement required by law. Updating these Terms does not retroactively change a separate treatment consent, financial agreement, or privacy authorization.

16. Governing Law and Preservation of Rights

These Terms are governed by Colorado law and applicable federal law, except where another mandatory legal requirement applies. If a provision is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

These Terms do not require mandatory arbitration, waive your right to file a regulatory complaint, or replace a separate agreement concerning your medical care. If these Terms conflict with a legally required patient protection, that protection controls.
